These Terms & Conditions govern your use of www.thebigcheese.store and, when online sales are enabled, purchases made through the website. Please read them carefully before using the website or placing an order.

Nothing in these Terms affects your statutory rights as a consumer.

We may suspend, withdraw, change or restrict access to all or part of the website where reasonably necessary, including for maintenance, security or business reasons.

4. Product Information

We take reasonable care to describe and display our products accurately. Because cheese and other food products can be handmade, cut to order, seasonal or naturally variable, appearance, weight and characteristics may vary reasonably from photographs or descriptions.

Where products are sold by approximate weight, the website or product description should explain how the final quantity and price are determined.

Product availability is subject to stock, seasonality and supplier availability. We may substitute or remove a product only where permitted and, where appropriate, after contacting you.

5. Allergens and Food Information

Food allergies and intolerances can be serious. We will provide legally required food information and allergen information as applicable. Customers with allergies or intolerances should review the product information carefully and contact us at hello@thebigcheese.store before ordering if they need further information.

Product recipes, ingredients and supplier information can change. Customers should also check labels and information supplied with the product before consumption.

6. Prices

Prices will be shown on the website in pounds sterling and will include applicable taxes where required. Delivery charges and other applicable charges will be shown before you commit to an order.

We may change prices at any time, but changes will not normally affect orders already accepted. If a pricing error is obvious and could reasonably have been recognised as an error, we may contact you before accepting or fulfilling the order.

7. Placing an Order

The website will display the steps required to place an order and will provide an opportunity to review and correct order information before submission. When the online shop is configured, the final order button will make clear where placing the order creates an obligation to pay.

Submitting an order is an offer to purchase. An automated acknowledgement does not necessarily mean we have accepted the order. A binding contract is formed when we send confirmation that we have accepted the order, or otherwise as clearly stated during checkout.

We reserve the right not to accept an order, for example because a product is unavailable, payment cannot be authorised, delivery is not available to the requested address, an obvious pricing or description error has occurred, or we reasonably suspect fraud or misuse.

8. Payment

Available payment methods will be displayed during checkout once our payment provider has been selected. Payment must be made using an accepted method. We do not ordinarily store complete payment-card details ourselves.

9. Delivery

Available delivery areas, methods, charges and estimated delivery times will be shown on the website or during checkout. We will deliver to the address supplied with the order.

Unless a different period has been agreed, goods ordered under a consumer distance contract will be delivered within the period required by applicable law.

You are responsible for providing an accurate delivery address and any information reasonably required for delivery. Because many of our products are perishable, you should ensure that somebody can receive the order or that any agreed safe-place or delivery instruction is appropriate.

10. Perishable Goods and Cancellation Rights

Consumer cancellation rights for online purchases are subject to statutory exceptions. In particular, the usual cancellation right may not apply to goods that are liable to deteriorate or expire rapidly. This can be relevant to cheese and other fresh or perishable foods.

Where a statutory cancellation right does apply to a product, we will provide the required pre-contract information about that right, the applicable cancellation period and how to exercise it. We will not seek to exclude any cancellation, refund or other consumer right that applies by law.

If you wish to cancel an order before dispatch, please contact hello@thebigcheese.store as soon as possible. Whether cancellation is possible will depend on the status and nature of the order and your statutory rights.

11. Problems With an Order

If goods arrive damaged, are not as described, are faulty, or there is another problem with your order, please contact us promptly at hello@thebigcheese.store with your order details and, where useful, photographs. Your legal rights in relation to faulty or misdescribed goods are not affected by these Terms.

12. Returns and Refunds

Our returns and refund arrangements will comply with applicable consumer law. Because some food products are perishable, different rules may apply depending on the product and reason for return. We may publish a separate Returns & Refunds Policy or provide the relevant information during checkout.

Nothing in these Terms limits your statutory remedies where goods are faulty, damaged, not as described or otherwise fail to meet applicable legal requirements.

13. Promotions and Discount Codes

Promotions and discount codes may be subject to additional terms, eligibility requirements, dates and exclusions. Unless stated otherwise, promotions cannot be exchanged for cash and may not be combined with other offers. We may withdraw or correct a promotion where there has been an obvious error, fraud or misuse, subject to applicable law.

Unless otherwise stated, the website and its content, including text, branding, graphics, photographs and design elements, are owned by or licensed to The Big Cheese Store Ltd and are protected by intellectual property law.
